Terms of Service

These Terms of Service ("Terms") govern your use of SendHero, a brand-voiced email marketing app for OpoShop stores provided by Found ("we", "us", "our"). By installing or using SendHero, you agree to these Terms. If you don't agree, don't use SendHero.

1. What SendHero is

SendHero is a tool that lets a merchant run email marketing for their own OpoShop store — scheduling campaigns, running behavior-triggered automations, building live customer segments, and drafting copy with AI. You, the merchant, control what is sent, to whom, and when. SendHero executes the campaigns and automations you configure; it does not decide your marketing for you.

2. Acceptable use

You agree to use SendHero lawfully and responsibly. You will not:

• Send email to people who have not consented to receive marketing from your store, or to purchased, scraped, or rented lists.
• Send spam, deceptive, fraudulent, or misleading content, or content that impersonates another business or person.
• Send unlawful, infringing, harassing, or otherwise objectionable content.
• Attempt to bypass unsubscribe or suppression handling, or email addresses that have opted out.
• Reverse-engineer, resell, or abuse the service, or use it to harm SendHero, OpoShop, or other users.

3. Your OpoShop store & data

To work, SendHero connects to your OpoShop store through OAuth and accesses store, customer, order, and product data as described in our Privacy Policy. You represent that you have the right to grant this access and to use your customers' data for the marketing you send. You can revoke access at any time by uninstalling SendHero from your OpoShop admin.

4. AI-generated content

The Pro AI features draft subject lines and body copy in your brand's voice. AI output is a starting point — you are responsible for reviewing, editing, and approving anything you send. We don't guarantee that AI-drafted copy is accurate, appropriate, or compliant, and you should treat it as a draft, not final copy.

5. Service availability

We work to keep SendHero available and reliable, but we don't guarantee uninterrupted or error-free operation. Email delivery depends on OpoShop's delivery infrastructure and factors outside our control, and we can't guarantee that every message reaches every inbox. We may modify, suspend, or discontinue features at any time.

6. Service provided "as is"

SendHero is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will meet your requirements or produce any particular marketing result.

7. Limitation of liability

To the maximum extent permitted by law, Found and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of SendHero. Our total liability for any claim relating to the service will not exceed the amount you paid us for SendHero in the three months before the claim (or, if you paid nothing, will be limited to USD $100).

8. Indemnification

You agree to indemnify and hold harmless Found from any claims, damages, or costs arising from your use of SendHero, the content you send, or your violation of these Terms or of any applicable law — including email and data-protection laws.

9. Termination

You may stop using SendHero at any time by uninstalling it from your OpoShop admin. We may suspend or terminate your access if you violate these Terms or use the service in a way that risks harm to others. Sections that by their nature should survive termination (such as liability, indemnity, and disclaimers) will survive.

10. Changes to these Terms

We may update these Terms as SendHero evolves. When we make material changes, we'll update the "Last updated" date above. Your continued use of SendHero after a change means you accept the updated Terms.

11. Provider

SendHero is provided by Found. These Terms are between you and Found. SendHero is an independent app that operates on the OpoShop platform; OpoShop is not a party to these Terms.
